At Pathfix (Pathfix Inc.,a Delaware corporation), maintaining the privacy and security of your Personal Data is our topmost priority. We are strongly committed to providing you a safe and secure experience while accessing and using (i) our Site – https://pathfix.com/, (ii) our integration platform, products, Software As A Service (SAAS) applications and services; and (iii) training and support services, collectively called the “Services”.. This Privacy Policy (“Privacy Policy”) describes our practices regarding use, maintenance, and disclosure of Personal Data that we collect through the Services. Our policy is to collect no personally identifiable information about you when you visit our web site unless you affirmatively choose to make such information available to us. However, our web servers may recognize some non-personal information such as your Internet location (IP address). We respect the privacy of your Personal Data and undertake to ensure that the data that you provide us with will be treated only in the manner described in this Privacy Policy.

Whenever the Privacy Policy mentions the terms “Pathfix” or “we” or “us” or “our”, it refers to Pathfix, Inc., a Delaware corporation, which is responsible for your Personal Data under this Privacy Policy.

We conduct our business in compliance with applicable laws and shall collect, use and process your Personal Data only in accordance with applicable data protection and security laws, regulations and guidelines. 

We urge you to read this Privacy Policy thoroughly. By accessing and using our Services, you will have represented your agreement to this Privacy Policy and bound by its terms. If you do not agree with the practices described in this Privacy Policy , please do not provide us with your Personal Data or interact with the Services.

Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Service.

1. SCOPE OF THE POLICY 

  1. This Privacy Policy applies to the Personal Data and information that we collect through the Services. To make our Services accessible to you and to administer and manage your relationship with us, we will necessarily need to collect, use, disclose and/or process your information and Personal Data, to which you consent by agreeing to this Privacy Policy.

For the purpose of this Privacy Policy the term Personal Data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that person.
  3. Our Privacy Policy applies to all visitors, users, and others who access our Services (“users“, “you”, “your”). If you are a corporate entity or an organisation, references to the terms “you” and “your” shall include your employees, representatives, agents and/or any other individuals to whom you allow access to your Account. 
  4. Our privacy and security practices in connection with the access and use of our Services are governed by the Terms of Service Agreement, which is a binding contract between you and us; available at https://pathfix.com/terms/, and which is incorporated herein by reference. Please be aware that this Privacy Policy does not govern all the information that we may process.
  5. You understand and agree that the Services may contain or enable links or integrations to third party websites, platforms and services.You agree that Pathfix does not have control over such third party services and products and that Pathfix provides such links and integrations in its Services solely for your convenience.Our Privacy Policy thus does not apply to such services offered by other companies, third party service providers or individuals. You should consider the privacy practices of those third-parties carefully.


2. INFORMATION WE COLLECT

We collect information that you provide us directly or automatically when you use the Services. The collection of your Personal Data shall be strictly restricted to what is necessary for the purpose of fulfilling the purposes identified herein below. We may collect and retain the following Personal Data from and about you if you interact with us through the Services;

a. Account and Profile Information: 

i. The information that you voluntarily provide when you register for an Account to access or use one or more of our Services and which shall include but shall not be limited to your name, company name, country of operation, email address, password, your designation, and other login information. 

ii. You may also ask us to import your contacts by giving us access to your third party services (for example, your email account) or to use your social networking information if you give us access to your account on social network connection services (inclusive of chat platforms).

iii. If you decide to avail any of our Services, and make payment for the same, we may collect your billing name, billing address and payment method. We do not store your credit card or debit card number, card expiry date or other details pertaining to your credit/ debit card on our Services. We use Stripe for processing financial transactions on our behalf, which is a PCI DSS compliant.Stripe and any such third parties with whom we share your Personal Data for processing financial transactions on our behalf shall be bound by our confidentiality and non-disclosure policy. The processing of payments will be subject to the terms, conditions and privacy policies of the Payment Processors in addition to this Agreement. Such Third Parties shall not use your financial information for any purpose other than to complete a transaction with you. 


b. Your Data: You may upload or transmit or give us access to your data, information, files, content or material while using the Services (“Your Data”) We collect and store Your data which you copy/paste, upload, link to, download, or access with the Services. If you add any data while using the Services that has been previously uploaded by you or another user, we may associate all or a portion of the previous data with your account rather than storing a duplicate.


The Services allow you to create connections or integrations between the third-party sites or applications you use. When you use the Services, information or content may be transferred from one application or site to another. We collect the information that is transferred between such third-party sites and applications. When you integrate our Services with a third-party site or application, the information we receive depends on the settings, permissions, and privacy Statement controlled by that third-party site or application.


We also collect the Personal Data of other individuals that users may provide when they submit content or information through the Services. For instance, a user may provide information about his/her teammates in the Workspace, including name and email address, to invite teammates to the Workspace to use the Services. 

c. Communications: Any information entered by you when you interact with the Services or our personnel for any purpose, including but not limited to reporting a problem with or difficulty using our Services or for providing feedback. When you join the Services by registering for an Account and when you affirmatively provide an email address and click the Sign Up button , you opt in to receive emails from us as permitted by law. To opt out of receiving emails from us, you may either use the “Unsubscribe” button at the end of our emails or send us an opt-out request at support@pathfix.com . Please note that you cannot opt-out of receiving certain administrative or legal notices from us.

d. Other Sources: Any information that we ask for and may collect from various sources, which may include but are not limited to, information you voluntarily provide us at any events, seminars, conferences, talks, promotions, surveys organised by us, and/or information we collect when you submit web forms on our Services or if you use interactive features of our Services. 

e. Automatically Collected Information: When you use or visit our Services, we may collect information regarding your use of the Services, including but not limited to statistics and logins, search queries and open posts, your Internet Protocol (IP) address, web browser type, web browser version, internet service provider, site trends, location, referring URL, timestamp information, app packages, app names, urls, email address, poll inputs and the operating system that your computer or device is running. The purpose of the information is for analyzing trends, administering the site, tracking users' movement on the website, and gathering demographic information.

f. We use such third-party services to optimise the functionality of our Services and to make our Services user friendly. We treat such data in the same manner as we treat Personal Data voluntarily provided by you, under this Privacy Policy.

3. HOW WE USE YOUR INFORMATION

We use the Personal Data and information that is collected from you or that you provide to us or that we collect through other sources for the purpose of fulfillment of our obligations under our agreement with you and/or to comply with our statutory legal obligations. Without prejudice to the above, enumerated hereunder is a non-exhaustive list of the purposes for which your Personal Data may be used/processed; 

  1. To provide you with information that may be requested by you from time to time;
  2. To contact you regarding our Services;
  3. To send promotional emails about new products, special offers or other information which we think you may find interesting using the email address which you have provided which you will have voluntarily opted in on to receive; You can stop receiving our promotional emails by following the unsubscribe instructions included in every email;
  4. To send you updates and confirmations of services availed; 
  5. To personalise your Account;
  6. To determine your eligibility for certain types of promotional offers;
  7. To enhance other information we have about you to help us better understand you, determine your interests and provide you with more relevant and compelling services; 
  8. To maintain, operate and improve the Services;
  9. Contact you to ensure that the information we have in our records is accurate or when in need of additional information to complete your profile;
  10. To facilitate communication and improve our business relationship with you and to respond to your queries, requests or complaints and/or resolve any issues and disputes which may arise in connection with any dealings with us;
  11. Create our own internal statistical for in-house analytical purposes;
  12. Prevent activity we determine to be potentially illegal; enforce this Privacy Policy and/or our Terms of Service or any other purpose referenced herein or therein;
  13. To control and monitor and ensure compliance with security arrangements and policies adopted by us, and also to ensure their compliance with the law and other regulatory obligations; 
  14. To comply with any request or direction or lawfully disclose information required by any applicable law, regulation, direction, court order, bylaw, guidance, circular or code applicable to us; 
  15. To monitor and identify areas of our Services in which improvement may be needed; 
  16. To investigate, detect and prevent any fraudulent transaction, unauthorised access to the services and prohibited or illegal activity or omission or misconduct; 
  17. We may use information for the security of our company, customers, employees and/or our Services.  
  18. We shall not use your Personal Data for any purpose, than for what it is collected. We may use your Personal Data for purposes not stated herein above but only with your express or implied  prior consent for such use. 
  19. We shall not be responsible for the actions of other third parties, nor are we responsible for any additional information you provide directly to any third parties.

4. SHARING YOUR INFORMATION

We do not rent, sell, share or disclose your Personal Data to third-parties without your consent. We may share some information about you with third parties in connection with your use of the Services but you will be notified of what information will be shared and with whom. Our information sharing with third-parties fall into these categories and purposes;

  1. Agents, Contractors, and Third Party Service Providers: We may share your information with our agents and contractors or other third party service providers (collectively referred to as the “Pathfix Subprocessors”) as needed to carry out the performance and functionality of the Services, fulfill your requests or authorized commercial transactions, support our business, host, manage and maintain our Website, develop applications for us, carry on analytics, store and backup our data or provide customer support. These Pathfix Subprocessors shall not store, retain, or use your information, including Personal Data for marketing or any other purpose except for processing the transaction or providing a service on our behalf. We may share aggregated, non-personally identifiable information publicly and with our partners – like publishers, advertisers or connected sites. Additional information about the Pathfix Subprocessors we use to facilitate and support delivery of our Services is set out at Pathfix Processors.


  1. Affiliated Entities: We may share information from or about you with subsidiaries, joint ventures, or other companies under common control, in which case they are legally bound to honor this Privacy Policy .
  2. Business Transfers: If we are acquired by or merged with another entity, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected about you to the other company. 
  3. Investigations: We will share your Personal Data with companies, organizations or individuals outside of Pathfix if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to, (i) Meet any applicable law, regulation, legal process or enforceable governmental request; (ii) Enforce applicable Terms of Service, including investigation of potential violation; (iii) Detect, prevent, or otherwise address fraud, security or technical issues or (iv) Protect against harm to the rights, property or safety of Pathfix, our users or the public as required or permitted by law. 
  4. We may with your prior and expressed consent share Personal Data for reasons not described in this Privacy Policy  with third parties.


5. TRANSFER OF YOUR PERSONAL DATA

  1. The information collected by us may be sent to the offices and servers of Pathfix and the authorized third parties referred to herein located in the United States of America and/or other countries around the world. By interacting with and/or using the Services you understand that your Personal Data will be transferred to such countries and you consent to such transfer. 
  2. We do not transfer your Personal Data with third parties, unless it is necessary to fulfill our obligations to you and as permitted by law. We shall make appropriate arrangements to ensure that your data is processed in a secure manner and in compliance with applicable data protection laws, specific to your country.  

6. CHANGING YOUR PERSONAL DATA

  1. The Personal Data that you provide can be accessed at any time through your account or you can contact our customer support at support@pathfix.com if you need help accessing your account.
  2. If you are a registered user, you may review, update or correct the Personal Data provided in your registration or account profile by changing your appropriate “account settings” within the profile option under your dashboard. 

7. OUR SECURITY POLICY FOR YOUR PERSONAL DATA

  1. We have made reasonable security arrangements to prevent unauthorised access, collection, use, disclosure, modification, loss, damage, disposal or similar risks of your Personal Data. We value the security of your Personal Data and have therefore adopted technical, managerial, physical, operational, electronic, procedural administrative and organisational security measures in accordance with applicable laws and regulations and industry standards to ensure the security of the Personal Data you entrust to us. 
  2. Although we have used our best efforts to ensure the security of your Personal Data, we cannot guarantee you that your Personal Data will never be disclosed in a manner that is inconsistent with this Privacy Policy. 
  3. Access to your Personal Data is allowed to only a restricted number of our personnel. All our employees and intermediaries, who have access to and process your Personal Data, are trained in handling Personal Data and are required to respect the confidentiality of your Personal Data. 
  4. You agree that any security breaches beyond our reasonable control are at your sole risk and discretion, we cannot and do not accept responsibility for the same.You are also responsible for ensuring that your account and the passwords of your account are protected. 8. COOKIES AND TRACKING TECHNOLOGIES

  1. We may collect Personal Data with the help of tracking tools like browser cookies. The term "cookies" refers to small pieces of information stored on the hard drive of your computer or computer while you view a site. The primary objective of cookies is recordkeeping and uniquely identifying your browser. 
  2. We use cookies to improve the quality of our Services. Cookies help us to tailor our Services to best suit your preferences and provide you with ease and convenience while accessing our Services. Not all data collected from cookies is Personal data, such information is collected for creating a better user experience. 
  3. We use traffic log cookies to identify which pages are being used. This helps us analyse data about web page traffic and improve our Services in order to tailor it to customer needs. We only use this information for statistical analysis purposes and then the data is removed from the system.
  4. Neither we nor any other Third Parties performing services on our behalf shall use cookies to automatically retrieve any Personal Data from your computer. If you do not wish to receive cookies, you may configure your browser either to notify you when you receive a cookie or to disable cookies. It is pertinent you understand that should you choose to disable cookies, some functions of Services may not work properly or may not work at all.

9. RETENTION OF YOUR PERSONAL DATA

  1. We will retain your Personal Data for as long as required to perform the purpose specified under this Privacy Policy. Upon termination of your Account by deletion or suspension, your Personal Data is destroyed or anonymised from our records and system. 
  2. When we have no ongoing legitimate business, operational, legal or other statutory need to process your Personal Data, we will either delete or anonymize it, or, if this is not possible (for example, because your Personal Data has been stored in backup archives), then we will securely store your Personal Data and isolate it from any further processing until deletion is possible. We may retain your Personal Data for the purposes authorized under this Privacy Policy , under our own internal data management policies, or in the event of a legal or other statutory requirement. 


10. ACCOUNT DEACTIVATION, REACTIVATION AND DELETION

  1. You may, at any point, request us to delete your Account by contacting our support team, at support@pathfix.com
  2. Upon deletion of your Account, we attempt to take all necessary measures to ensure that Your Personal Data is not visible to other users, however, we disclaim all liability if such data has been previously downloaded by any user prior to such deletion of the Account.

11. PERSONAL DATA OF MINORS

Our Services are not directed to persons under 18 years of age. We do not consciously collect Personal Data from minors (i.e individuals under 18 years of age and/or any such age as required in your country for you to be authorised to use our Services) and respect the privacy of minors who may inadvertently use our Services and provide us with Personal Data. If you are a minor, do not submit any Personal Data to us. If you are a parent or a guardian we strongly recommend you to supervise the online activity of your minor children and ensure that your children do not disclose any Personal Data. If you believe that we may have unknowingly collected Personal Data from minors without parental consent, kindly contact us at the contact details provided herein below, so that we may adopt immediate measures to remove the information from our servers. If we become aware that a minor under 18 years has provided us with Personal Data, we will take steps to delete such information from our files.

12. LINKS TO OTHER SITES

Our Services contains links and integrations to other third party websites. If you choose to click on one of these links you may be taken to websites we do not control.This Privacy Policy does not apply to the privacy practices of those websites. We do not control and assume no responsibility for the content, security or privacy policies and practices on those websites. We request you to read the privacy policies of those sites to determine how they collect, process, use, disclose and protect your Personal Data.   

13. ADDITIONAL TERMS FOR CALIFORNIA RESIDENTS

a. If you are a resident of California, we shall handle your Personal Data in consonance with the California Consumer Privacy Act (CCPA). We will not, without your consent, disclose your Personal Data. You hereby give us consent to disclose your Personal Data for business purposes. You consent to and agree to direct us to and/or use the Services to intentionally disclose Personal Data or to intentionally interact with a third party. 

b. We will not, without your consent, sell and/or disclose your Personal Data for valuable consideration. If you have given us your Personal Data, we have not sold and/or disclosed it for valuable consideration in the 12 months immediately preceding the last update of this Privacy Policy.

c. You consent and agree that we may disclose the following categories of such Personal Data of consumers (as defined under the CCPA) in the 12 months immediately preceding the last update of this Privacy Policy. 

i. Identifiers such as a consumer's name, email address etc.

  2. Right to deletion - You have a right to request deletion of your Personal Data. This right is a subjective right, we may not comply with a data deletion request if we are permitted and/or required under law. 
  3. Right to disclosure - You have a right to request us to disclose the categories of Personal Data collected, sources from which Personal Data is collected, purpose of collecting Personal Data, categories of third parties with whom Personal Data is shared. 
  4. You have a right not to be discriminated against for exercising certain rights under California law.

14. ADDITIONAL TERMS FOR EU CITIZENS

a. This is applicable only to persons in the European Union. We ensure that all your data that we collect, store, use and process is done in compliance with the General Data Protection Regulation (GDPR). Elucidated hereunder are additional terms applicable to citizens of the European Union.

b. Legal basis for processing your Personal Data: If you are an EU citizen, we process Personal Data only for purposes for which we collect it. We shall process data only if we have your consent or if processing is necessary for complying with our legal obligations or where the processing is in our legitimate interest. Where we rely on your consent as the legal basis, you have the right to withdraw your consent at any time, but this will not affect any processing that has already taken place. iii. Right to rectification - You may at any time request for rectification of your Personal Data that we process. You may also complete Personal Data if it is incomplete.

Right to restriction of processing - You have a right to restrict the processing of Personal Data if you contest the accuracy of the data, lawfulness of processing and or if you have objected to processing of data or if the data is no longer needed for the purpose of processing. We will inform you when such restrictions are lifted.

vi. Right to object - You have a right to object to the processing of your Personal Data. You have a right to object where your Personal Data is processed for marketing purposes.

15. ADDITIONAL TERMS FOR UK CITIZENS

a. These additional terms shall be applicable to persons in the United Kingdom. We shall collect, use, store and process your Personal Data only in accordance with the Data Protection Act, 2018 and other regulations and guidelines on data privacy protection and data security. Elucidated hereunder are rights available to persons in the UK; 

  1. Right to access - You have a right to and are allowed access to your Personal Data that is processed. 
  2. We reserve the right to modify, revise and/or amend this Privacy Policy from time to time so as to reflect our current privacy practices. We may change the Privacy Policy without sending a prior notice of the same. We will post an updated copy/ new version on our Services. Any changes to this notice will come into effect on posting to this page. You are requested to check our Website periodically for such updates. If you access our Services after a notice of change has been published on our page, you hereby provide us your consent to the changed terms. 

17. DISPUTE RESOLUTION

18. TIMEFRAME FOR PROCESSING USER REQUESTS

On receipt of a request for the exercise of any of the rights stated under this Privacy Policy, we shall make best efforts to respond to and resolve the same without undue delay within a period of 30 (thirty) days of its receipt. If the requests received are complex or numerous we may, by giving you notice, extend this said period of 30 (thirty) days.
